Meeting
called to order at 8:30 a.m. by President Eric Negaard.
Those Board members present were: Mary Lambert, Geneal Thompson, Joni
Huff, with Linda Swope absent. Bureau
staff present: Rayola Jacobson,
Budd Hetrick, John Kersey, and Kim Aksamit. Legal Counsel: Roger Hales and
Stephanie Guyon Deputy Attorney General.
Motion
made by Ms. Huff to accept the minutes from February 7, 2005, seconded by Ms.
Thompson; motion carried.
Motion
made by Ms. Thompson to accept the minutes from May 23, 2005, seconded by Ms.
Lambert; motion carried.
Rayola
Jacobsen presented the legislative report. The Board was advised that proposed
rule changes should be submitted no later than August 1 and law changes
submitted before September 1. The Board was advised that the Bureau would be
providing services to four new licensing boards after July 1, 2005.
Budd
Hetrick presented the financial report. The Board was advised that they were in
good financial shape and their cash balance continues to increase each year.

Motion made by Ms. Thompson, to accept the recommendation of the Bureau and the
Board which authorizes an advisory letter to be sent to the salon and employees
and the case be closed, seconded by Ms. Lambert; motion carried.

Motion made by Ms. Lambert, to accept the recommendation of the Attorney
Generals office, seconded by Ms. Thompson; motion carried.
COS-2004-29
and COS-2004-30 Motion made by Ms. Huff, to take the recommendation of the
Attorney Generals office with the exception that the recommendation 10 days
suspension be increased to 30 days with the fine of $600.00 in addition to
investigative cost and attorney fees and the now licensed nail tech should pay a
fine of at least $300.00 as well as investigative cost and attorney fees, both
individuals be placed on probation for a period of 2 years, seconded by Ms.
Thompson; motion carried.
COS-2004-30
Motion made by Ms. Thompson, that the Attorney Generals office further pursues
investigation in allowing unlicensed practice in the establishment, seconded by
Ms. Lambert; motion carried.
Debra Roope
from DL Roope Administrations Inc gave a presentation regarding administration
of exams.
Representative
Joe Cannon and John Hulse gave a presentation with the request to expand the
exam sites through out Idaho.
Motion made
by Ms. Thompson, to schedule a special board meeting on June 27, 2005 and
request that the lawyer for Razzle Dazzle and the Deputy Attorney General be
present to have oral arguments regards to case number COS-2004-20, seconded by
Ms. Lambert; motion carried.
Motion made
by Ms. Huff, to consider and review COS-2004-05 at the special board meeting on
June 27, 2005, seconded by Ms. Thompson; motion carried.
Claus and
Andrea from PCS gave a presentation regarding administration of exams.
Motion made
by Ms. Huff to accept the curriculum for the Hair Academy in Rexburg Idaho with
the stipulation that the bond be made payable to the Idaho Bureau of
Occupational Offices for $25,000.00, seconded by Ms. Thompson, motion carried.
Motion made
by Ms. Thompson, to accept the documentation from Headmasters School of Hair
Design of Lewiston and that it does meet the 10th grade education or
its equivalent to Idaho standards as it pertains to Isa Bashon, seconded by Ms.
Huff; motion carried.
Motion made
by Ms. Lambert, to not accept the curriculum for Academy Di Firenza because the
hours and curriculum are not broken down, seconded by Ms. Huff; motion carried.
Motion made
by Ms. Thompson, to table the clarification of the word patron as used in Rule
500.04, seconded by Ms. Huff; motion carried.
Motion made
by Ms. Huff, that the board approve the 900 hour esthetics program for
Headmasters School of Hair Design in CDA and Boise, seconded by Ms. Thompson;
motion carried.
Motion made
by Ms. Huff, to have the Board cover travel expenses to the NIC National Meeting
in Washington DC including airfare, hotel accommodations, per diem, and
honorarium for Joni Huff, Eric Negaard, Mary Lambert, and Linda Swope, seconded
by Ms. Lambert, motion carried.
Motion made
by Ms. Lambert, for the Board to allow reimbursement of expenses for Geneal
Thompson regarding attendance to the NIC National meeting in Washington DC for
expenses not covered by NIC, seconded by Ms. Huff; motion carried.
Motion made
by Ms. Thompson, to accept the 600 hour esthetics curriculum for Burton Academy
in Post Falls Idaho, seconded by Ms. Huff; motion carried.
Motion made
by Ms. Thompson, that the Board direct the Bureau to address, update and change
Rule 800 and Rule 010 seconded by Ms. Huff; motion carried.
Motion made
by Ms. Lambert, to table the discussion of reviewing applications for
examination until the special Board meeting of June 27, 2005, seconded by Ms.
Thompson; motion carried.
Motion made
by Ms. Thompson, to direct the Bureau to assist the Board in reintroducing a
single bill making the apprenticeship program null and void, seconded by Ms.
Huff; motion carried.
Motion made
by Ms. Lambert, that the Board will stipulate that until rule 800 is re-drafted,
monomer and or Brush cleaner are acceptable methods of sanitation and
disinfectant of acrylic nail brushes, seconded by Ms. Huff; motion carried.
(This motion
was rescinded later in the meeting. Board
motion cannot overrule State Law)

carried.

by Ms. Thompson, to come out of executive session, seconded by Ms. Huff; motion

by Ms. Lambert, that the Board will rescind the motion that the Board will
stipulate that until rule 800 is re-drafted, monomer and or brush cleaner are
