Board Meeting Minutes

Minutes of June 27, 2005

 

The Idaho State Cosmetology Board meeting was called to order at 2:03 p.m., Monday, June 27, 2005 at the Bureau of Occupational Licenses, Owyhee Plaza, 1109 Main Street, Suite 220, Boise, Idaho.

NEW BUSINESS

The Board reviewed the curriculum submitted by D & L Academy for their esthetics course.  After full review and discussion it was moved by Geneal Thompson not to approve the curriculum as received until updates have been made to the practical portion of the curriculum.  Seconded by Linda Swope, motion carried.

OLD BUSINESS

The Board reviewed the updated curriculum submitted by Wendy Coffman Florence for Academy Di Firence.  Moved by Joni (Joan) Huff to accept the updated curriculum for Academy Di Firence.  Seconded by Mary Lambert, motion carried.

The Board discussed the word “Patron” as used in Rule 500.04.  The Board determined that more time was needed before they could clarify a definition of the word Patron.

 

FORMAL DISCIPLINARY ACTION

Eric Negaard, has recused himself from discussion and voting privileges in Case No. COS-2004-20.  Geneal Thompson to resume meeting on behalf of Chairman.

The Board heard Oral Arguments from Terry Michaelson, Attorney for Razzle Dazzle and Ken Stringfield, Deputy Attorney General for the State.  Each party was allotted twenty minutes for oral argument.

Moved by Geneal Thompson that the Board go into executive session to discuss matters exempt from public disclosure.  Seconded by Joan (Joni) Huff motion carried.  The time being 3:55 p.m.

Moved by Joni Huff that the Board come out of executive session.  Seconded by Linda Swope motion carried.  The time being 4:12 p.m.

COS-2004-20:  Moved by Linda Swope that License No. CC-226568 issued to Razzle Dazzle College of Hair be suspended for a period of One Hundred Eighty (180) days with the entire One Hundred Eighty (180) days stayed conditioned upon Respondents compliance with the regulations of the Idaho State Board of Cosmetology.  Respondent shall pay a One Thousand and No/100 Dollar ($1000.00) fine per each student for a total of Two Thousand and No/100 Dollars ($2000.00).  Respondent will be responsible for paying the investigation costs and attorney fees accrued.  Seconded by Mary Lambert, motion carried.

Ken Stringfield, Deputy Attorney General submitted a Memorandum to the Board.  The Board made their recommendation in conjunction with the recommendation of the Attorney General for disciplinary action in Case No. COS-2005-21.  No motions were made.

Mr. Stringfield also, presented three (3) each Stipulations And Consent Orders for Case Nos. COS-2005-13, COS-2005-16 &18, and COS-2005-22.

COS-2005-13:  Moved by Joan (Joni) Huff to accept the Stipulation And Consent Order as written and to authorize the Chairman to sign on behalf of the Board.  Seconded by Geneal Thompson, motion carried.

COS-2005-16 & 18:  Moved by Linda Swope to accept the Stipulation And Consent Order as written and to authorize the Chairman to sign on behalf of the Board.  Seconded by Joan (Joni) Huff, motion carried.

COS-2005-22:  Moved by Mary Lambert to accept the Stipulation And Consent Order as written and to authorize the Chairman to sign on behalf of the Board.  Seconded by Linda Swope, motion carried.

Moved by Geneal Thompson that the Board go into executive session to discuss matters exempt from public disclosure.  Seconded by Joan (Joni) Huff motion carried.  The time being 4:30 p.m.

Moved by Joan (Joni) Huff that the Board come out of executive session.  Seconded by Mary Lambert, motion carried.  The time being 4:47 p.m.

COS-2004-22:  Moved by Linda Swope to adopt the Hearing officers Findings Of Fact, and Conclusions Of Law.  That License No. CI-17508 issued to Respondent, Kathy Saco be revoked.  Respondent shall pay the costs and attorney fees incurred in the investigation and prosecution.  Seconded by Joan (Joni) Huff, motion carried.

Moved by Geneal Thompson that the Board go into executive session to discuss matters exempt from public disclosure.  Seconded by Joan (Joni) Huff, motion carried.  The time being 4:53 p.m.

Moved by Geneal Thompson that the Board come out of executive session.  Seconded by Linda Swope, motion carried.  The time being 5:01 p.m.

COS-2004-14:  Moved by Joan (Joni) Huff to adopt the Hearing officers Findings Of Fact, Conclusions Of Law And Recommended Order.  That Respondent Dung Anh Le, License No. NT-221626 be suspended for a period of One hundred twenty (120) days with Ninety (90) days stayed.  At the conclusion of suspension the license shall be placed on probation for a period of two (2) years.  Respondent shall pay a fine in the amount of Two Thousand Dollars ($2,000.00) and pay the costs and attorney fees incurred in the investigation and prosecution.  Seconded by Geneal Thompson, motion carried.

COS-2004-16 & 17:  Moved by Joan (Joni) Huff, to adopt the Hearing officers Findings Of Fact, Conclusions Of Law And Recommended Order.  That Respondent Isabelle Santi, License No. NT-222264 Owner of Boise Nails, License No. CS-5775 be suspended for a period of One hundred twenty (120) days with Ninety (90) days stayed.  At the conclusion of suspension the license(s) shall be placed on probation for a period of two (2) years.  Respondent shall pay a fine in the amount of Three Thousand Dollars ($3,000.00) and pay the costs and attorney fees incurred in the investigation and prosecution.  Seconded by Linda Swope and carried
