Board Meeting Minutes

Minutes of September 26, 2005

 

The Idaho State Cosmetology Board meeting was called to order at 2:00 p.m., Monday, September 26, 2005 at the Bureau of Occupational Licenses, Owyhee Plaza, 1109 Main Street, Suite 220, Boise, Idaho. 

Roll Call:                   Geneal Thompson, Board Member

                                    Joan (Joni) Huff, Board Member

                                    Linda Swope, Board Member

 

Bureau Staff:          Rayola Jacobsen, Bureau Chief

                                    Budd Hetrick, Deputy Bureau Chief

                                    Roger Hales, Administrative Attorney

                                    Marcie McGinty, Investigations Coordinator

 

Others Present: Ken Stringfield, Deputy Attorney General 

Eric Negaard, Chair and Mary Lambert, Board Member, absent, excused. 

Geneal Thompson will conduct meeting on behalf of Eric Negaard, Chair whom is absent. 

FORMAL DISCIPLINARY ACTION 

Ken Stringfield, Deputy Attorney General submitted a Memorandum to the Board.  After review and discussion the Board made their recommendations to Mr. Stringfield in conjunction with the recommendations in the memorandum for disciplinary action for Case Numbers COS-2006-1 and COS-2005-20.  No motions were made. 

Mr. Stringfield also, presented four (4) each Stipulations And Consent Orders for Case Numbers COS-2004-28, COS-2004-29, COS-2004-30 and COS-2005-15

COS-2004-28:  Moved by Joan (Joni) Huff to accept the Stipulation And Consent Order as written in the License matter of Idaho Stampede, CS-225343 and to authorize Geneal Thompson to sign as acting chair on behalf of the Board.  Seconded by Linda Swope, motion carried. 

COS-2004-29:  Moved by Linda Swope to accept the Stipulation And Consent Order as written in the license matter of Lonnie L. Vo, RC-223774, and to authorize Geneal Thompson to sign as acting chair on behalf of the Board.  Seconded by Joan (Joni) Huff, motion carried. 

COS-2004-30:  Moved by Linda Swope to accept the Stipulation And Consent Order in the license matter of Thuy Thanh Le, NT-22272 and to authorize Geneal Thompson to sign as acting chair on behalf of the Board.  Seconded by Joan (Joni) Huff, motion carried. 

COS-2005-15:  Moved by Linda Swope to accept the Stipulation And Consent Order in the license matter of The Hair Angler, CS-224254 and Cammie Garner, RC-12057 and, to authorize Geneal Thompson to sign as acting chair on behalf of the Board.  Seconded by Joan (Joni) Huff, motion carried. 

Roger Hales discussed the Findings of Fact, Conclusions of Law and Recommended Orders issued by the Hearing Officer for Case Numbers COS-2005-7, 8, 9, & 19 and Case Number COS-2005-12.  After review and discussion the Board made the following motions. 

COS-2005-7, 8, and 9:  Moved by Joan (Joni) Huff to adopt the Hearing Officers Findings of Fact, Conclusions of Law, And Recommended Order in the Matter of the Licenses of Hiep Van Nguyen, Huong Tran and Thuytien T. Nguyen.  That each individual Nail Technician License and each individual Establishment License issued to Respondents be suspended for a period of One Hundred Eighty (180) days with Ninety (90) days stayed.  At the conclusion of suspension each license will be placed on probation for a period of Two (2) years.  Each Respondent shall pay a fine in the amount of One Thousand Dollars ($1,000.00) and pay the recovery of costs and attorney fees incurred in the investigation and prosecution.  Seconded by Linda Swope, motion carried. 

COS-2005-19:  Moved by Joan (Joni) Huff to adopt the Hearing Officers Findings of Fact, Conclusions of Law and Recommended Order.  That Respondent Le Thi LeHang, License Number NT-225109 be suspended for a period of One Hundred Twenty (120) days with Ninety (90) days stayed.  At the conclusion of the suspension the licenses shall be placed on probation for a period of Two (2) years.  Respondent shall pay a Three Hundred Dollar ($300.00) fine and pay Three Hundred Dollars ($300.00) for recovery of costs and attorney fees for the investigation and prosecution   Seconded by Linda Swope, motion carried.

COS-2005-12:  Moved by Linda Swope to adopt the Hearing Officers Findings of Fact, Conclusions Of Law And Recommended Order.  That License Number NT-1639 issued to Respondent Uyen Le, be suspended for a period of One Hundred Eight (180) days with One Hundred Twenty (120) days stayed.  At the conclusion of the suspension License Number NT-1639 shall be placed on probation for a period of Two (2) years.  Respondent shall pay a Nine Hundred Dollar ($900.00) fine and pay the recovery of the costs and attorney fees incurred in the investigation and prosecution.  Seconded by Joan (Joni) Huff, motion carried. 

Moved by Joan (Joni) Huff to have Attorney Hales draft the Final Orders for signature and execution at the Board’s next scheduled meeting on Monday, October 3, 2005.  Seconded by Linda Swope, motion carried. 

Moved by Joan (Joni) Huff that the meeting be adjourned.  The time being 3:55 p.m.  Seconded by Linda Swope, motion carried.
