Minutes of May 21, 2002
Roll Call:

Minutes from March 19, 2002 board meeting and April 2, 2002
conference call were reviewed. Minutes
stand approved as submitted.
Ms. Jacobsen reported on the changes the Bureau has made
recently – added two additional phone lines and negotiated for more office
space. She explained that, in order
to save resources, the Bureau is trying to reduce the amount of paper used.
In order to further this goal the Board asked that their folders contain
the parliamentary meeting booklet, notepad and a copy of the laws and rules.
Moved by Dr. Hollingsworth that all Board correspondence continue being
distributed to the full board; electronically when possible.
Seconded by Dr. Sterling, carried.
Mr. Hetrick gave a report on the electronic aspects of
using the web page for Board documents. He
also showed the Board how the new system works and the public information that
is available with the new system. Budd
presented the investigative report electronically to the Board.
Discussion was held on continuing education and the proof
required for Chiropractors wanting to renew their licenses.
As the rule states, it is the responsibility of the licensed Chiropractor
to maintain proof of continuing education.
Peer Review was discussed. Dr. Sterling will distribute the
conclusion page of the procedure for peer review to the Board for review.
Moved by Ms. Averill that Board move into executive session
to discuss potential litigation. Seconded
by Dr. Hollingsworth, carried.
Moved by Dr. Sterling to come out of executive session. Seconded by Dr. Mayo, carried.
Moved by Dr. Sterling
directing Mr. Hales to, on behalf of Dr. Moldenhauer, request voluntary
mediation of the case. If consent to such mediation cannot be obtained, court
ordered mediation would be sought. Seconded
by Dr. Mayo.
Moved by Dr.
Hollingsworth that Mr. Hales send a letter to plaintiffs requesting their
consent for a re-review of the previous reviews at issue, or their concerns with
the proposal, with the response by a date certain.
If no consent or objection is received within time required, a re-review
will be conducted with rotated reviewers without cost.
Discussion was held on an editorial article that appears in
the WCA newsletter written by Dr. Roberts.
Moved by Ms. Averill that the Bureau write a response to the article in
the WCA newsletter relaying that the matter is under investigation.
Seconded by Dr. Mayo, carried.
Moved by Dr. Hollingsworth that Mr. Hales be directed to
search within Idaho and Federal laws to determine if anything proscribes the
practice of chelation therapy and whether there are restrictions on method of
delivery (i.e. oral, venous, and injection).
Seconded by Ms. Averill, carried.
DOCUMENTATION COMMITTEE
Dr. Harper reported that he has not received any names for
committee appointments, so there is no committee at this point.
Ideally, the committee will consist of two IACP members and four members
at large, with Dr. Harper chairing the committee.
It was recommended that Dr. Henze and Dr. Price be considered for a
position on the committee.
Break for lunch until 1:15 p.m.
Moved by Dr. Sterling to go into executive session to
discuss matters concerning potential litigation and not subject to public
disclosure. Seconded by Dr.
Hollingsworth, carried.
Moved by Dr. Sterling to come out of executive session.
Seconded by Dr. Hollingsworth, carried.
Dr. James Davis appeared before the Board requesting
reinstatement of his Idaho Chiropractic license that had been cancelled for over
five years. Moved by Dr.
Hollingsworth that the license for Dr. Davis be reinstated and that the
appropriate fee be paid and that he have an option of having the license issued
immediately or wait until July 1, 2002. Seconded
by Dr. Sterling, carried.
Discussion held on statute changes that would make license
renewal dates consistent with birth dates rather than June 30 of each year. A
draft of the proposal will be distributed to the Board for review and a
conference call will be scheduled.
Discussion was held on correspondence received from
Practice Mechanix regarding Nerve Conduction Velocity testing. Dr. Harper suggested that the Board develop a policy manual
that would outline the scope of approved practice for Chiropractic Physicians in
Idaho. Moved by Dr. Hollingsworth
that the Bureau write a letter to the Board of Medicine to see if they have
certification requirements for nerve conduction velocity studies.
Seconded by Dr. Mayo, carried.
Discussion was held on clinical treatment guidelines.
Dr. Sterling reported that ACA (American Chiropractic Association) does
not endorse any guidelines (i.e. Mercy Conference, Olson).
He further reported that FCLB does not endorse any guidelines whatsoever
and they also recommend that states do not endorse guidelines.
Moved by Dr. Hollingsworth that the Bureau contact the other state
licensing boards and ask the following: 1) We are reviewing peer review
guidelines. Please send us information on what you are currently using for
guidelines and any prospective changes; 2) We are reviewing minimum
documentation guidelines. Please send us information on what you are using and
any prospective changes. Seconded
by Ms. Averill, discussion held. Motion
amended to clarify that FCLB may have the information and to start with FCLB for
the information. Amendment and amended motion passed.
Discussion was held on the letter from Deborah Green
regarding the multi-level sale of products by chiropractors.
Moved by Dr. Hollingsworth that the letter be referred to Mr. Hales.
Seconded by Ms. Averill, carried.
Discussion was held on the letter from Larry Hammond, D.C
requesting that his license be issued prior to the expiration of his temporary
permit. Moved by Dr. Hollingsworth
that the license be issued. Seconded
by Dr. Mayo, carried.
Conference call will be held 6/13 at 12:00 mdt to review
proposed legislation regarding the expiration dates of licenses and on chelation
if the research has been done.
Moved by Dr. Mayo to adjourn at 3:00 p.m. Seconded by Ms. Averill, carried.
